Terms & Conditions
RTG DETECTOR RENTAL TERMS AND CONDITIONS
By renting equipment from RTG – Reilly's Treasured Goods, LLC ("RTG"), the renter acknowledges that they have read, understood, and agree to the following Terms and Conditions.
1. RENTAL AGREEMENT
The renter accepts full responsibility for all rented equipment from the time it is received until it has been physically returned to RTG and successfully inspected.
2. VALID IDENTIFICATION REQUIRED
A valid government-issued photo identification and a valid credit or debit card are required for all rentals.
3. SECURITY DEPOSIT
RTG may authorize or charge a security deposit equal to twenty-five percent (25%) of the current retail value of the rented equipment.
The security deposit may be applied toward:
- Unpaid rental charges
- Late fees
- Cleaning fees
- Repair costs
- Replacement costs
- Missing accessories or components
- Any other amounts due under this Agreement
The security deposit does not limit the renter's financial responsibility.
4. NO DAMAGE WAIVER OR INSURANCE PROVIDED
RTG does not provide insurance or a damage waiver for rented equipment.
The renter remains fully responsible for any loss of or damage to the rented equipment regardless of cause, except where prohibited by law.
The renter is encouraged to determine whether coverage may exist under their homeowners, renters, business, or personal insurance policies.
5. RESPONSIBILITY FOR LOSS, THEFT, OR NON-RETURN
The renter is fully responsible for the full current retail replacement cost of any rented equipment that is:
- Lost
- Stolen
- Abandoned
- Destroyed
- Confiscated
- Not returned for any reason
If rented equipment is not returned as agreed, the renter authorizes RTG to charge the payment method on file for the current retail replacement value of the equipment, including all included accessories, applicable taxes, and any amounts due under this Agreement.
6. DAMAGE TO EQUIPMENT
The renter is responsible for any damage occurring during the rental period beyond normal wear and tear.
Normal wear and tear does not include, but is not limited to:
- Broken coil ears
- Cracked housings
- Damaged displays
- Bent or damaged shafts
- Water intrusion
- Damaged battery compartments
- Damaged connectors
- Corrosion resulting from improper cleaning
- Unauthorized repairs or modifications
- Damage resulting from misuse, negligence, abuse, accidents, or improper operation
RTG will determine, in its reasonable discretion, whether equipment will be repaired or replaced and the associated repair or replacement costs.
7. WATER USE
Equipment shall only be used within the manufacturer's published waterproof or water-resistant specifications.
Any damage resulting from use beyond those specifications, including water intrusion into non-waterproof components, is the renter's responsibility.
Equipment exposed to saltwater should be thoroughly rinsed with fresh water after each use in accordance with the manufacturer's recommendations.
Damage resulting from improper cleaning or corrosion is the renter's responsibility.
8. BATTERIES AND CHARGING
Rechargeable batteries shall be charged only using the charger supplied by RTG or as specifically approved by RTG.
Damage resulting from improper charging, incompatible chargers, misuse, neglect, or improper storage is the renter's responsibility.
9. LATE RETURNS
Equipment not returned by the agreed return date and time may be subject to additional rental charges at RTG's current daily rental rate until returned.
Failure to communicate with RTG regarding overdue equipment may result in collection efforts and additional charges as permitted by law.
10. RETURN INSPECTION
Equipment is considered returned only after it has been received and inspected by RTG.
Acceptance of equipment at the time of return does not constitute final acceptance of its condition.
RTG reserves the right to identify and charge for damage or missing components discovered during inspection within a reasonable time after return.
11. INCLUDED COMPONENTS
All rented equipment must be returned with the same components provided at the time of rental, including but not limited to:
- Search coil(s)
- Batteries
- Chargers
- Headphones
- Carrying case
- Arm cuff
- Coil cover
- Protective covers
- Manuals
- Any additional accessories included with the rental
Missing or damaged components will be charged at the current replacement cost.
12. PROPER USE OF EQUIPMENT
The renter agrees to operate all equipment safely, responsibly, and only within the manufacturer's intended specifications.
The renter assumes all risks associated with the use of the rented equipment.
The renter is solely responsible for complying with all federal, state, and local laws, regulations, permits, and property restrictions governing the use of metal detecting equipment.
13. NO TRANSFER OF POSSESSION
Rental equipment may not be loaned, assigned, transferred, subleased, or provided to any other person without RTG's prior written consent.
The original renter remains fully responsible for the equipment at all times.
14. CONDITION OF EQUIPMENT
The renter acknowledges that all equipment has been inspected by RTG and found to be in satisfactory operating condition prior to rental unless otherwise documented.
RTG may photograph or video record the condition of rental equipment before release and upon return. These records may be used to document the condition of the equipment and resolve disputes regarding damage or missing components.
15. PAYMENT AUTHORIZATION
The renter expressly authorizes RTG to charge the payment method provided for:
- Rental charges
- Security deposits
- Late fees
- Damage repairs
- Replacement costs
- Missing accessories
- Cleaning fees
- Collection costs
- Any other amounts due under this Agreement
16. COLLECTION COSTS
If RTG is required to pursue collection of unpaid amounts, the renter agrees to pay all reasonable costs of collection permitted by law, including collection agency fees, court costs, attorneys' fees, and other related expenses.
17. CHARGEBACKS
The renter agrees not to dispute or initiate a chargeback for charges authorized under this Agreement.
If an improper chargeback is initiated, the renter remains responsible for all amounts due under this Agreement together with any additional fees and collection costs permitted by law.
18. NO WARRANTY
RTG makes no warranties, express or implied, including any implied warranties of merchantability or fitness for a particular purpose.
RTG does not guarantee that the rented equipment will locate valuables, artifacts, coins, jewelry, relics, gold, or any other items.
19. EQUIPMENT FAILURE
If equipment malfunctions through no fault of the renter, RTG's sole obligation shall be, at its option:
- Repair the equipment;
- Replace it with comparable equipment if available; or
- Provide a prorated refund for the unused rental period.
RTG shall not be liable for lost finds, lost profits, travel expenses, lodging expenses, missed opportunities, or any consequential or incidental damages resulting from equipment malfunction.
20. LIMITATION OF LIABILITY
To the fullest extent permitted by law, RTG shall not be liable for any injury, death, property damage, loss, delay, lost profits, lost finds, consequential damages, incidental damages, or expenses arising from the rental, possession, transportation, or use of the rented equipment.
21. GOVERNING LAW
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida.
Any legal action arising under this Agreement shall be brought exclusively in the state or federal courts located in Broward County, Florida, and the renter consents to the jurisdiction of those courts.
22. ACCEPTANCE OF TERMS
By completing the rental transaction, the renter acknowledges that they have read, understood, and voluntarily agree to be bound by these Terms and Conditions.
The renter further authorizes RTG to charge the payment method on file for any amounts due under this Agreement.
